What is the Difference Between a Felony and a Misdemeanor?

The main difference between a felony and misdemeanor in Texas is the severity of the consequences of a conviction. In the state courts of Texas, misdemeanors are divided into three sections:

  • Class C Misdemeanor: Fine only, such as a traffic ticket.
  • Class B Misdemeanor: Up to a $2,000 fine and 180 days in jail, for crimes such as possession of a small amount of marijuana.
  • Class A Misdemeanor: Up to a $4,000 fine and a year in jail.

There are also multiple levels of felonies in Texas state courts. We will take every legal step necessary to reduce the charges you are facing.

  • State Jail Felony: Up to two years in Texas Department of Corrections without parole.
  • 3rd Degree Felony: Two to ten years in prison.
  • 2nd Degree Felony: Two to 20 years in prison.

  • Capital Felony: A life sentence without parole or the death penalty.
