How a DUI Happens

Hays County law enforcement must have probable cause in order to make a traffic stop, for example, weaving in the traffic lane, driving at excessive or low rates of speed or failing to observe traffic laws.

Once the officer has you pulled over, he or she can provide evidentiary support such as smelling alcohol on the driver's breath, hearing slurred speech or observing dilated pupils. The officer may now proceed to field sobriety tests to confirm his or her suspicions. If you flunk the one-legged stand or the walk and turn, the officer will arrest you and take you down to the station for a breathalyzer. If your blood alcohol concentration is 0.08 percent or greater, your driver's license is automatically suspended.
