Sealing Juvenile Records in Texas

A juvenile criminal record exists when a person is arrested, taken into custody or charged with a crime while between the ages of 10 and 17. Juvenile criminal records can be accessed by law enforcement officials. It may also be available to future potential employers, universities and licensing agencies. Records regarding counseling or treatment are only accessible to authorized users.

Most records are permanent unless the record is eligible for sealing and the juvenile's family hires a lawyer to file a petition in court to have the record sealed. Once it is sealed, it is removed from the criminal history database.

However, some crimes are eligible for automatic restriction when certain conditions are met. If your child has not committed a crime since turning 17, certain crimes will become automatically restricted when they turn 21. This does not destroy or seal the record, but restricts access to everyone but criminal justice agencies for criminal justice purposes, such as investigating and prosecuting crimes.

If your child was tried as an adult or prosecuted outside of juvenile court, their crimes are not eligible for restricted access. They still have the option of getting the crime expunged or the record sealed.
